Terms of Service

Acceptance of terms

The PocketCoach service is operated by Appitect Digital s.r.o., Company ID: 295 41 280, with registered office at Příčná 1892/4, Nové Město, 110 00 Prague 1, Czech Republic, registered with the Municipal Court in Prague, file no. C 446922. By creating an account or using the service, you agree to these terms. If you disagree, do not use the service.

User account

Using the service requires creating an account. You are responsible for keeping login credentials confidential and for all activity performed under your account.

Subscriptions and billing

The service is provided on a monthly or annual subscription basis.

• We offer a 14-day free trial. A payment method is required to start the trial, but you are not charged during the trial period. If you cancel before the trial ends, no charge is made.
• After the trial ends, the paid subscription begins automatically based on your chosen plan. Subscriptions are billed in advance via Stripe.
• You can cancel anytime under Settings → Subscription. Cancellation applies at the end of the current billing period; you retain full access until then.
• Refunds are not provided unless required by law. In justified cases (technical errors on our side) we handle individually.

Acceptable use

When using the service you agree not to:

• Violate applicable laws or third-party rights
• Attempt to gain unauthorized access to systems or other users' data
• Burden the infrastructure in a way that disrupts service operation
• Use the service to send unsolicited communications (spam)

Your content

All data you enter (clients, programs, messages) remains your property. You grant us only the limited license necessary to provide the service (display, backup, processing).

Intellectual property

Software, design, documentation, and other materials are protected by copyright and remain our property. You receive only a non-transferable license to use the service.

Availability

We strive for continuous availability but do not guarantee 100% uptime. We are not liable for outages caused by infrastructure providers (Vercel, Supabase, Stripe) or force majeure.

Limitation of liability

Our liability is limited to the amount of subscription fees paid in the last 12 months. We are not liable for indirect damages, lost profits, or data loss. We recommend exporting key data regularly.

Termination

We may terminate an account in case of material breach (with prior notice when possible). After termination you have 30 days to export data.

Governing law

These terms are governed by the laws of the Czech Republic. Disputes will be resolved by the competent courts in Prague.

Changes to terms

We may update these terms. For material changes we'll notify you by email at least 30 days in advance. Continued use constitutes acceptance of the updated version.
